Odd Pieces Inc. (“Odd Pieces,” “we,” “us,” or “our”) values your privacy. This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information when you visit or use the Odd Pieces website and online store, purchase our products, contact us, submit content, participate in a promotion, or sign up for email or SMS communications.

This Privacy Policy applies only to services that link to it. Third-party websites, marketplaces, social-media platforms, and services have their own privacy practices and policies.

1. Personal Information We Collect

The personal information we collect depends on how you interact with us.

Information you provide directly

We may collect:

  • Contact information, such as your name, email address, telephone number, billing address, and shipping address.
  • Order and transaction information, such as the products you purchase, order number, transaction amount, discounts used, delivery preferences, order history, return information, and payment status.
  • Payment information. Payment-card and other payment details are generally collected and processed directly by Shopify and our payment providers. We may receive transaction confirmations and limited payment information needed to administer your purchase, returns, refunds, fraud reviews, and chargebacks.
  • Account information, if you create a customer account, such as your account identifier, login credentials, saved addresses, and preferences.
  • Customer-support information, such as messages, photographs, replacement or return requests, warranty claims, survey responses, and other information you provide when communicating with us.
  • Marketing information, such as your email and SMS subscriptions, communication preferences, promotion entries, and records showing when, where, and how you provided or withdrew consent.
  • Reviews and submitted content, such as product ratings, comments, photographs, videos, social-media handles, or other material you choose to submit.
  • Other information you voluntarily provide, including information submitted through forms, surveys, giveaways, contests, or communications with us.

Information collected automatically

When you visit or interact with the Site, we and our service providers may automatically collect:

  • Device type, operating system, browser type and version, language, and time zone.
  • Internet Protocol address and approximate location inferred from it.
  • Cookie identifiers, advertising identifiers, and similar online identifiers.
  • Pages and products viewed, searches, referring pages, links clicked, session activity, and interactions with our Site.
  • Cart, checkout, order, and abandoned-cart activity.
  • Information about how you interact with our emails, advertisements, and SMS links, such as delivery status and link clicks.
  • Diagnostic, security, and fraud-prevention information.

We collect this information through cookies, pixels, tags, software development kits, server logs, and similar technologies.

Information from other sources

We may receive personal information from:

  • Shopify and other commerce-platform providers.
  • Payment processors, fraud-prevention providers, and financial institutions.
  • Shipping carriers, warehouses, and fulfillment providers.
  • Customer-service, review, email, and SMS platforms.
  • Analytics and advertising providers.
  • Social-media platforms when you interact with our accounts or advertisements.
  • Retail, marketplace, or promotional partners where permitted by law.
  • Other parties when you direct them to provide information to us.

2. How We Use Personal Information

We may use personal information to:

  • Operate, maintain, secure, and improve our Site and online store.
  • Process payments, fulfill orders, arrange delivery, and provide invoices or order confirmations.
  • Manage returns, refunds, replacements, warranties, disputes, and chargebacks.
  • Communicate about orders, deliveries, account activity, support requests, and other requested services.
  • Create and administer customer accounts.
  • Respond to questions and provide customer service.
  • Display, administer, and moderate reviews or other submitted content.
  • Personalize products, content, offers, and Site experiences.
  • Conduct analytics and understand how customers use the Site.
  • Measure the performance of our products, communications, and advertising.
  • Send marketing communications where we have consent or another lawful basis.
  • Send SMS communications as described below.
  • Detect, investigate, and prevent fraud, misuse, security incidents, and unlawful activity.
  • Enforce our agreements and protect our rights, customers, personnel, and property.
  • Comply with tax, accounting, consumer-protection, privacy, court-order, and other legal requirements.
  • Complete a financing, merger, acquisition, reorganization, sale, or other business transaction.
  • Carry out other purposes disclosed when the information is collected or with your direction or consent.

3. SMS and Mobile Communications

Information collected for SMS

When you opt in to an Odd Pieces SMS program, we may collect:

  • Your mobile telephone number.
  • Your SMS consent and subscription status.
  • The date, time, source, form, and disclosure through which you opted in.
  • Messages you send to us and your interactions with our messages.
  • Message delivery status, link clicks, and related engagement information.
  • Device and carrier information made available through the messaging service.
  • Cart and checkout activity used for cart reminders, where that feature is enabled.

Providing a telephone number during checkout or for delivery purposes does not, by itself, subscribe you to promotional SMS messages. Consent to email marketing also does not constitute consent to SMS marketing.

How we use SMS information

Depending on the program you join and the choices you make, we may use SMS information to:

  • Send promotional offers, discounts, product announcements, back-in-stock notices, and other marketing messages.
  • Send cart reminders when you have opted in to marketing texts and left items in your cart.
  • Send requested order confirmations, shipping notices, delivery updates, account alerts, and other service-related messages.
  • Respond to customer-service inquiries.
  • Maintain consent, suppression, and compliance records.
  • Monitor and improve the performance and reliability of the SMS program.

Consent to promotional SMS messages is voluntary and is not a condition of purchasing from Odd Pieces. Message frequency varies, and message and data rates may apply.

Odd Pieces does not use precise GPS or device-location information to send SMS messages or location-based SMS offers.

SMS data sharing

We do not sell, rent, or disclose mobile information, SMS opt-in data, or SMS consent status to third parties or affiliates for their own marketing or promotional purposes.

We may disclose this information to service providers that help us operate the SMS program, including messaging-platform providers, telecommunications carriers, customer-support vendors, link-management services, and vendors that assist with message delivery, security, or compliance. These parties may use the information only to provide services to Odd Pieces or as otherwise permitted by law.

Opting out of SMS messages

You may withdraw consent to promotional SMS messages at any time by:

  • Replying STOP to an Odd Pieces text message.
  • Using another opt-out method provided in the message.
  • Sending another clear request that you no longer wish to receive the messages.
  • Contacting us at hello@oddpieces.com.

We may send one non-promotional message confirming that your opt-out was processed. We may retain your telephone number on a suppression list so that we can honor your request and maintain legally required consent and opt-out records.

Opting out of SMS marketing does not prevent us from communicating with you through email or another channel about an existing order, customer-service request, legal notice, or other non-marketing matter.

4. Cookies and Similar Technologies

We and our service providers use cookies and similar technologies for the following purposes:

  • Strictly necessary technologies, which support checkout, fraud prevention, security, account login, shopping-cart functions, and other core Site features.
  • Preference technologies, which remember selections such as language, market, region, and account preferences.
  • Analytics and performance technologies, which help us understand Site traffic, diagnose problems, and improve the Site.
  • Advertising technologies, which help measure advertising, build audiences, limit repeated advertisements, and display advertising that may be more relevant to you.

Where applicable law requires consent, we use non-essential cookies and similar technologies only after you have made a choice through our cookie banner or privacy controls.

You can manage available choices through the Cookie Preferences or Your Privacy Choices link in our Site footer. You may also manage cookies through your browser settings, although blocking strictly necessary cookies may prevent parts of the Site from functioning correctly.

Where required by applicable law and supported by our systems, we recognize browser-based opt-out preference signals, such as Global Privacy Control, as a request to opt out of the sale or sharing of personal information and targeted advertising.

5. Analytics and Interest-Based Advertising

We may use analytics and advertising services to understand Site usage, measure advertising, and present offers that may be relevant to you.

These providers may receive information such as:

  • Cookie and device identifiers.
  • Internet Protocol address and approximate location.
  • Browsing, search, cart, and purchase activity.
  • Interactions with our Site and advertisements.
  • Limited contact or transaction information where lawfully permitted.

This information does not include your SMS opt-in data or SMS consent status.

6. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

  • Shopify and commerce providers that host and operate our online store.
  • Payment and fraud-prevention providers that process payments, verify transactions, and protect against fraud.
  • Fulfillment and delivery providers, including warehouses, postal services, couriers, customs brokers, and logistics providers in Canada, the United States, Asia, and other relevant locations.
  • Technology and hosting providers that supply cloud storage, security, Site functionality, and technical support.
  • Communication providers that support customer service, email, SMS, and transactional notifications.
  • Analytics and advertising providers that measure Site and campaign performance or support targeted advertising.
  • Review, survey, contest, and promotion providers where we use those services.
  • Professional advisers, including accountants, auditors, insurers, consultants, and legal counsel.
  • Government bodies, regulators, courts, law enforcement, or other parties when disclosure is required by law or reasonably necessary to protect legal rights, safety, or security.
  • Parties to a business transaction, such as a purchaser, investor, lender, or adviser involved in a merger, financing, acquisition, reorganization, or sale.
  • Other parties at your direction or with your consent.

Service providers are generally required to process personal information for the services they provide to us and subject to appropriate contractual restrictions. Some platforms may process information for their own purposes under their own privacy policies and legal obligations.

7. Shopify

Our online store is hosted by Shopify. Shopify processes personal information when you visit the Site, use Shopify-supported services, or make a purchase.

Where Shopify Network Intelligence or related enhanced services are enabled, Shopify may use information about your interactions with Odd Pieces, Shopify, and other Shopify merchants to provide services such as personalization, analytics, store performance improvements, fraud prevention, and advertising.

Information may be disclosed to Shopify and other providers located outside your province, state, or country to provide these services. More information is available in Shopify’s Consumer Privacy Policy, and eligible users can exercise certain choices through Shopify Privacy Controls.

8. Sale, Sharing, and Targeted Advertising

We do not sell personal information to third parties in exchange for money.

Some privacy laws define “sale” or “sharing” more broadly and may treat certain disclosures involving advertising cookies, pixels, online identifiers, or cross-context behavioral advertising as a sale, sharing, or use for targeted advertising even when no money is exchanged.

Where these definitions apply, you may opt out through the Your Privacy Choices link on our Site or through a recognized opt-out preference signal such as Global Privacy Control.

We do not knowingly sell or share the personal information of individuals under 16 years of age.

Mobile information, SMS opt-in data, and SMS consent status are excluded from disclosures to third parties or affiliates for their own marketing or promotional purposes.

9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including:

  • Order and transaction records for fulfillment, customer service, returns, warranties, tax, accounting, fraud prevention, chargebacks, and legal requirements.
  • Account information while an account remains active and for a reasonable period afterward.
  • Customer-support records for as long as needed to resolve the request and maintain appropriate business records.
  • Marketing information while you remain subscribed.
  • SMS and email consent records for as long as needed to demonstrate consent, administer preferences, honor opt-outs, and comply with law.
  • Suppression records for as long as needed to prevent communications you have declined.
  • Device, cookie, analytics, and advertising information according to the applicable cookie settings, provider retention periods, and the purposes for which the information was collected.

When personal information is no longer required, we may delete it, de-identify it, or securely isolate it until deletion is possible. Legal, accounting, fraud-prevention, dispute, and security requirements may require us to retain certain records after a deletion request.

10. Security

We use reasonable administrative, technical, organizational, and physical safeguards intended to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

No internet, mobile-network, or storage system can be guaranteed to be completely secure. You should use appropriate precautions when transmitting information and protect your account credentials.

11. International Processing and Transfers

Odd Pieces, Shopify, and our other providers may process personal information in Canada, the United States, and other countries where our service providers, warehouses, fulfillment partners, or personnel operate.

Privacy laws in those countries may differ from the laws where you live, and information may be accessible to courts, law enforcement, or government authorities in accordance with local law.

Where required, we use recognized safeguards for international transfers, such as contractual protections and service-provider commitments.

12. Children’s Privacy

Our products may be enjoyed by children, but the Site’s purchasing functions, customer accounts, promotions, and marketing programs are intended for adults and a general audience. The Site is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13.

Purchases should be made by an adult or with the involvement of a parent or legal guardian. If you believe a child has provided personal information to us improperly, contact us so that we can review and, where appropriate, delete it.

The existing “under 12” language should therefore be changed to under 13, which aligns with the threshold used by the U.S. Children’s Online Privacy Protection Rule. Because Odd Pieces advertises that its products are suitable for both children and adults, its forms and marketing systems should still be configured as general-audience, adult-directed commerce tools. 

13. Legal Bases for EEA and UK Processing

Where European Economic Area or United Kingdom data-protection law applies, we process personal information on one or more of the following bases:

  • Performance of a contract, including processing orders, payments, delivery, returns, and requested services.
  • Consent, including certain email or SMS marketing, non-essential cookies, and personalized advertising where consent is required.
  • Legitimate interests, including operating and improving the Site, providing support, preventing fraud, securing our systems, understanding business performance, and conducting permitted marketing. We consider the potential effect on your rights before relying on legitimate interests.
  • Compliance with legal obligations, including tax, accounting, consumer-protection, regulatory, and lawful-request requirements.

You may withdraw consent at any time. Withdrawal does not affect processing that occurred before consent was withdrawn.

14. Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • Request confirmation of whether we process your personal information.
  • Access or obtain a copy of your personal information.
  • Correct inaccurate or incomplete information.
  • Request deletion of personal information.
  • Request a portable copy of certain information.
  • Restrict or object to certain processing.
  • Withdraw consent.
  • Opt out of the sale or sharing of personal information.
  • Opt out of targeted advertising.
  • Limit certain uses of sensitive personal information.
  • Appeal a refusal to act on a request where applicable.
  • Submit a complaint to the privacy or data-protection regulator where you live.

We may need to verify your identity before completing certain requests. Verification information will be used only to process and document the request. An authorized agent may submit a request where permitted by law, although we may require evidence of the agent’s authority and verification of the relevant individual.

We will not unlawfully discriminate against you for exercising a privacy right. Some information may be exempt from a request, including information we must retain for legal obligations, security, fraud prevention, accounting, or the establishment or defense of legal claims.

15. Automated Decision-Making

We do not use personal information to make decisions based solely on automated processing that produce legal or similarly significant effects concerning customers.

Shopify, payment processors, and fraud-prevention providers may use automated tools to identify potentially fraudulent, abusive, or high-risk transactions. These tools may flag a transaction for review, require additional verification, or temporarily restrict activity.

16. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our products, technology, providers, privacy practices, or legal obligations.

When we make changes, we will post the revised policy and update the “Last updated” date. We may provide additional notice when required by law or when a change materially affects how we handle personal information.
